Event Policies

Our policies are designed to provide the best possible experience for all visitors to Gong Space Mallorca.

By registering for an event or workshop, you agree to comply with our policies. Please note that for some events, particularly those taking place at other locations, other policies may apply, which are listed on the event or ticket-sales page or sent to you in advance by email. All policies apply regardless of individual circumstances (this includes COVID-19, accidents, illness and any other foreseeable or unforeseen circumstance).

If you do not follow the policies, your participation in the event or training course will be cancelled without a refund. We are committed to maintaining a respectful and welcoming environment, and anyone who is rude or disruptive to other participants, the event, or the course leaders will be asked to leave without a refund.

Public Events at Gong Space Mallorca

Advance registration is required for all events. Arrival time is 15 minutes before the event starts; please arrive at this time to check in and get settled. All events start at the scheduled time. No entry is permitted after the exact scheduled start time.

All sales are final. Tickets are transferable to another person only for the same date and time. Should you receive a refund of the ticket price due to extraordinary circumstances, ticket-issuing and credit-card fees will never be refunded.

MINIMUM ATTENDANCE: if attendance for a given event is fewer than 3 people, it may be cancelled. Those who have purchased tickets will be notified as soon as possible (usually the evening before the event) and will receive a full refund or a credit toward another date.

Please do not touch the instruments; if you damage something, you will be required to replace it. Please come sober! If you are under the influence of drugs or alcohol, you will be asked to leave without a refund.

Photo policy (photos/audio/video): no photos or recordings of any kind are permitted. Water in closed containers is allowed; no other food or drink is permitted. Please arrive without perfume or strong essential oils out of respect for other attendees; if you have a strong scent, you may be asked to leave the room.

Rates are subject to change without notice. We reserve the right to refuse service.

Private Events at Gong Space Mallorca

All of the above policies apply to group events at Gong Space Mallorca. A booking fee equal to the event minimum (typically EUR 450) is required to secure your date and time. Once a date and time are agreed, we will send you an invoice to settle the minimum amount. The remaining payment (if any) will be sent in a separate invoice and is due 24 hours before your event begins.

No refunds are given for changes to the number of attendees made less than 24 hours before the booking time. One date change is allowed, provided at least 7 days’ notice is given; the rescheduled date must fall within 30 days of the original date. Reschedules made between 48 hours and 7 days before the event incur a fee of EUR 100, and EUR 200 if made between 24 and 48 hours before the booking. No date changes are permitted less than 24 hours before the event starts, for any reason. All payments are final, no refunds; reschedules are allowed as stated above.

Published rates are subject to change without notice. Public holidays may carry different minimum rates than published. The quote for your private event may differ from the published rates depending on the individual circumstances of the event.

No food or drink is permitted in the sound bath area. Discounts for regular (weekly/monthly) bookings are available with a minimum 3-month commitment; contact us for more information. Any kind of outside items (e.g. party favours) must be approved before being brought into the centre. All sessions end at the scheduled time; if your group arrives late, we will still end at the scheduled time.

General Terms and Conditions with Customer Information

1) Scope of Application

1.1 These General Terms and Conditions (hereinafter “GTC”) of Gong Space Mallorca/owner: Matthias Dahms (hereinafter “Seller”) apply to all contracts concluded between a consumer or a trader (hereinafter “Customer”) and the Seller relating to all goods and/or services presented in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected, unless otherwise agreed in writing.

1.2 These GTC apply accordingly to contracts for the delivery of vouchers, unless expressly agreed otherwise.

1.3 Within the meaning of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader within the meaning of these GTC is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their independent trade or profession.

2) Conclusion of Contract

2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers by the Seller, but serve to enable the Customer to submit a binding offer.

2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. After placing the selected goods in the virtual shopping cart and going through the electronic ordering process, the Customer submits a legally binding contractual offer with respect to the goods contained in the shopping cart by clicking the button that concludes the ordering process. The Customer may also submit the offer to the Seller by email or post.

2.3 The Seller may accept the Customer’s offer within five days by sending the Customer a written order confirmation or an order confirmation in text form (fax or email), whereby receipt of the order confirmation by the Customer is decisive; or by delivering the ordered goods to the Customer, whereby receipt of the goods by the Customer is decisive; or by requesting payment from the Customer after the Customer has placed the order. If several of the aforementioned alternatives apply, the contract is concluded at the time the first of these alternatives occurs. The period for acceptance of the offer begins on the day after the Customer sends the offer and ends at the expiry of the fifth day following the sending of the offer. If the Seller does not accept the Customer’s offer within the aforementioned period, this is deemed a rejection of the offer, with the consequence that the Customer is no longer bound by their declaration of intent.

2.4 When an offer is submitted via the Seller’s online order form, the text of the contract is stored by the Seller after conclusion of the contract and sent to the Customer in text form (e.g. email or fax) after the Customer’s order has been sent. The Seller does not make the contract text accessible beyond this. If the Customer has created a user account in the Seller’s online shop before sending their order, the order data will be archived on the Seller’s website and can be accessed by the Customer free of charge via their password-protected user account by entering the corresponding login details.

2.5 Before submitting a binding order via the Seller’s online order form, the Customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means of better recognising input errors can be the browser’s zoom function, which enlarges the display on the screen. The Customer can correct their entries during the electronic ordering process using the usual keyboard and mouse functions until they click the button that concludes the ordering process.

2.6 German, English and Spanish are available for the conclusion of the contract.

2.7 Order processing and contact generally take place by email and automated order processing. The Customer must ensure that the email address provided for order processing is correct, so that emails sent by the Seller can be received at that address. In particular, when using SPAM filters, the Customer must ensure that all emails sent by the Seller or by third parties commissioned by the Seller to process the order can be delivered.

3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further information on the right of withdrawal can be found in the Seller’s withdrawal policy.

3.3 The right of withdrawal does not apply to consumers who, at the time the contract is concluded, do not belong to a member state of the European Union and whose sole place of residence and delivery address, at the time the contract is concluded, are outside the European Union.

4) Prices and Payment Terms

4.1 Unless otherwise stated in the Seller’s product description, the prices quoted are total prices that include statutory VAT. Any additional delivery and shipping costs will be stated separately in the respective product description.

4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the Seller is not responsible and which are to be borne by the Customer. These include, for example, costs for money transfers by credit institutions (e.g. transfer fees, exchange fees) or import duties or taxes (e.g. customs duties). Such costs relating to money transfers may also arise if delivery is not made to a country outside the European Union but the Customer makes the payment from a country outside the European Union.

4.3 The payment option(s) will be communicated to the Customer in the Seller’s online shop.

4.4 If advance payment by bank transfer has been agreed, payment is due immediately after conclusion of the contract, unless the parties have agreed a later due date.

4.5 If payment is made using a payment method offered by PayPal, payment processing takes place via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”), subject to PayPal’s terms of use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full, or — if the Customer does not have a PayPal account — subject to the terms and conditions for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

4.6 If the “PayPal Direct Debit” payment method is selected, PayPal will collect the invoice amount from the Customer’s bank account after a SEPA Direct Debit Mandate has been issued, but not before the deadline for pre-notification on behalf of the Seller has expired. Pre-notification is any communication (e.g. invoice, policy, contract) to the Customer announcing a debit by SEPA Direct Debit. If the direct debit is not honoured due to insufficient funds in the account or the provision of incorrect bank details, or if the Customer objects to the debit despite not being entitled to do so, the Customer shall bear the costs incurred by the relevant credit institution as a result of the chargeback, if they are responsible for it.

5) Delivery and Shipping Terms

5.1 Unless otherwise agreed, goods will be delivered by shipment to the delivery address specified by the Customer. In processing the transaction, the delivery address specified in the Seller’s order processing is decisive. Notwithstanding this, if the PayPal payment method is selected, the delivery address provided by the Customer to PayPal at the time of payment is decisive.

5.2 If delivery of the goods fails for reasons for which the Customer is responsible, the Customer shall bear the reasonable costs incurred by the Seller as a result. This does not apply to return costs if the Customer effectively exercises their right of withdrawal; in that case, the provisions of the Seller’s withdrawal policy shall apply to return costs.

5.3 Collection by the Customer is not possible for logistical reasons.

5.4 Vouchers will be provided to the Customer by email or by post.

5.5 Shipping within the EU: orders are generally shipped the same day if the item is in stock and the order is received by 12:00 CET. However, delivery time may be several days after purchase, depending on order size. If an item is not in stock, delivery time for gongs may range from 2 to 6 months. This is because Gongland gongs are exclusively hand-crafted to the finest standard and each gong is a unique piece that needs time to mature and continues to be refined during that time. The stated delivery time is based on the manufacturer’s information and our own experience.

5.6 We use DHL Express, UPS and DACHSER for domestic and international orders, depending on which carrier offers the most favourable rates. NOTE: our international shipping prices do NOT include duties or customs/brokerage fees that may be charged by the destination country or the carrier. The Customer is 100% responsible for any additional duties or customs/brokerage fees.

6) Retention of Title

If the Seller makes advance payment, they retain title to the delivered goods until the purchase price owed has been paid in full.

7) Liability for Defects (Warranty)

7.1 If the purchased item is defective, the statutory provisions on liability for defects shall apply.

7.2 The Customer is asked to report delivered goods with obvious transport damage to the carrier and to inform the Seller of this. If the Customer fails to do so, this shall have no effect whatsoever on their statutory or contractual claims for defects.

8) Special Terms for Processing Goods to Customer Specifications

8.1 If, according to the content of the contract, the Seller owes not only the delivery of goods but also the processing of goods according to certain Customer specifications, the Customer must provide the operator with all content necessary for processing, such as texts, images or graphics, in the file formats, formatting, image and file sizes specified by the operator, and grant them the necessary rights of use. The Customer is solely responsible for procuring and acquiring the rights to this content. The Customer declares and assumes responsibility for ensuring that they have the right to use the content provided to the Seller. In particular, they shall ensure that no third-party rights are infringed, in particular copyright, trademark and personal rights.

8.2 The Customer shall indemnify the Seller against any third-party claims that may be asserted against the Seller in connection with an infringement of their rights through the contractual use of the Customer’s content by the Seller. The Customer shall also bear the reasonable costs of the necessary legal defence, including all court and legal fees at the statutory rate. This shall not apply if the Customer is not responsible for the infringement. In the event of a claim by a third party, the Customer is obliged to provide the Seller immediately, truthfully and completely with all information necessary to examine the claims and mount a defence.

8.3 The Seller reserves the right to refuse to process orders if the content provided by the Customer for this purpose violates legal or official prohibitions or offends common decency. This applies in particular to the provision of anti-constitutional, racist, xenophobic, discriminatory, offensive, youth-endangering and/or violence-glorifying content.

9) Redemption of Promotional Vouchers

9.1 Vouchers issued free of charge by the Seller as part of promotional campaigns with a specified validity period, and which cannot be purchased by the Customer (hereinafter “promotional vouchers”), can only be redeemed in the Seller’s online shop and only within the specified period.

9.2 Individual products may be excluded from the voucher promotion if a corresponding restriction arises from the content of the promotional voucher.

9.3 Promotional vouchers can only be redeemed before completing the ordering process. Subsequent offsetting is not possible.

9.4 Only one promotional voucher can be redeemed per order.

9.5 The value of the goods must be at least equal to the amount of the promotional voucher. Any remaining credit will not be refunded by the Seller.

9.6 If the value of the promotional voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller can be selected to settle the difference.

9.7 The credit balance of a promotional voucher is neither paid out in cash nor does it bear interest.

9.8 The promotional voucher will not be refunded if the Customer returns goods paid for in whole or in part with the promotional voucher within the scope of their statutory right of withdrawal.

9.9 The promotional voucher is transferable. The Seller may make payment with discharging effect to the respective holder who redeems the promotional voucher in the Seller’s online shop. This does not apply if the Seller has knowledge, or is grossly negligently unaware, of the lack of authorisation, legal incapacity, or lack of power of representation of the respective holder.

10) Redemption of Gift Vouchers

10.1 Vouchers that can be purchased via the Seller’s online shop (hereinafter “gift vouchers”) can only be redeemed in the Seller’s online shop, unless otherwise stated on the voucher.

10.2 Gift vouchers and any remaining balance of gift vouchers are valid and redeemable for 12 months. Remaining credit will be credited to the Customer until the expiry date.

10.3 Gift vouchers can only be redeemed before completing the ordering process. Subsequent offsetting is not possible.

10.4 Several gift vouchers can be redeemed in a single order.

10.5 Gift vouchers can only be used to purchase goods and not to purchase further gift vouchers.

10.6 If the value of the gift voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller can be selected to settle the difference.

10.7 The balance of a gift voucher is neither paid out in cash nor does it bear interest.

10.8 The gift voucher is non-transferable. The Seller will make payment to the holder to whom the gift voucher was issued in the Seller’s online shop. This does not apply if the Seller has knowledge, or is grossly negligently unaware, of the lack of authorisation, legal incapacity, or lack of power of representation of the respective holder.

11) Refund and Return Policy

11.1 We offer a 15-day return policy from the date your item was delivered. If 15 days have passed since your purchase, we unfortunately cannot offer you a refund or exchange. Items sold: only regular-priced items can be refunded; unfortunately, sale items and items purchased at a discount cannot be refunded. Exchanges: we will only replace or exchange items that are defective or damaged. If you would like to exchange an item, please email us at info@gongspacemallorca.com.

11.2 Shipping costs for returning an item are borne by the Customer. To return your product, please send it via UPS to the following UPS service point:

We do not guarantee that we will receive your returned item.

11.3 Gongs that have been played with so-called gong drivers (Super Rub, Flumies, Friction Mallets, etc.) CANNOT be returned.

11.4 Original shipping costs are non-refundable, even for products purchased as part of a free-shipping promotion. If you receive a refund, the cost of the original shipping charges will be deducted from your refund. We will ask for proof of purchase to complete your return.

11.5 Please do not send your order back to the manufacturer. Returns to the showroom: for all gongs and accessories purchased in person at our showroom in Es Palmer, the sale is considered final.

11.6 Other items that cannot be returned: gift vouchers, downloadable audio and software products.

11.7 A partial refund will only be granted if an item is not in its original condition, is damaged, or is missing parts for reasons that are not our error.

11.8 Refund: once we have received and inspected your return, we will email you to let you know we have received your returned item, and also inform you of the approval or rejection of your refund. If approved, your refund will be processed and automatically credited back within a certain number of days.

11.9 Late or missing refunds: if you haven’t received a refund yet, first check your bank account again. Then contact your bank or PayPal, as it may take some time before your refund is officially posted. If you have done all of this and you still have not received your refund, please contact us at info@gongspacemallorca.com.

12) Applicable Law

12.1 All legal relationships between the parties shall be governed by Spanish law, excluding the law on the international sale of goods. For consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.

12.2 Furthermore, this choice of law regarding the statutory right of withdrawal shall not apply to consumers who, at the time the contract is concluded, do not belong to a member state of the European Union and whose sole place of residence and delivery address, at the time the contract is concluded, are outside the European Union.

13) Jurisdiction

If the Customer acts as a merchant, a legal entity under public law, or a special fund under public law with its registered office in Spanish territory, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller’s registered office. If the Customer’s registered office is outside Spanish territory, the Seller’s registered office shall be the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from it can be attributed to the Customer’s professional or commercial activity. In the above cases, however, the Seller is in any case entitled to bring proceedings before the court at the Customer’s registered office.

14) Alternative Dispute Resolution

14.1 The EU Commission provides a platform for online dispute resolution on the internet at the following link: https://ec.europa.eu/consumers/odr. This platform serves as a point of contact for the out-of-court resolution of disputes arising from online purchase or service contracts involving a consumer.

14.2 The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but is generally willing to do so.
